These Terms of Service ("Terms") govern your access to and use of Brevn's website, dashboard, APIs, and embedded chat widget (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who may use Brevn

You must be at least 18 years old and able to form a binding contract. If you use Brevn on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@brevn.com if you suspect unauthorized access.

3. The Service

Brevn helps you deploy an AI chat agent on your website. Features may include website crawling, AI-powered responses, lead capture, analytics, calendar booking, and widget customization. Features vary by plan and may change over time.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or deceptive purposes
• Upload or index content you do not have rights to use
• Attempt to bypass usage limits, security controls, or billing restrictions
• Reverse engineer, scrape, or disrupt the Service except as permitted by law
• Use the Service to generate spam, malware, or abusive automated communications

5. Your content and website data

You retain ownership of content you provide and of data from your website. You grant Brevn a limited license to host, process, and display that content solely to provide and improve the Service, including generating AI responses for your visitors.

You are responsible for ensuring your use of Brevn complies with applicable laws, including privacy, marketing, and consumer protection requirements for your visitors.

6. AI-generated responses

AI responses are generated automatically based on indexed content and your settings. Brevn does not guarantee accuracy, completeness, or suitability of AI output. You remain responsible for reviewing your agent configuration and how the Service is used on your website.

7. Subscriptions and billing

Paid plans renew according to the billing terms shown at checkout unless canceled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice for future billing periods.

8. Third-party services

The Service may integrate with third-party providers such as Google (sign-in and calendar), payment processors, and hosting providers. Your use of those services may be subject to their separate terms and policies.

9. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk to the Service or other users, or fail to pay applicable fees. You may stop using the Service at any time. Upon termination, your right to use the Service ends, but sections that should survive termination will remain in effect.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREVN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREVN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO BREVN IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You will defend and indemnify Brevn against claims arising from your content, your website, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
